Patients already on hormone therapy get a tapering-off period of up to six months, but there is no transition period for puberty blockers or surgeries. The rule is a funding restriction, not a ban: states may keep paying with their own money, and Washington and Oregon have said they will. CMS received nearly 35,000 public comments when it published the rule in August, with over 90 percent opposed.\u003C\u002Fp>\r\n\u003Cp>Pressure on hospitals is escalating in parallel. On September 18, NYU Langone Health and the University of Pittsburgh Medical Center (UPMC) settled with the U.S. Department of Justice for $8.5 million and $950,000 respectively, agreeing to stop providing such care to patients under 18 in exchange for ending civil and criminal inquiries and shielding patient records from grand jury subpoenas. Since May, the Cleveland Clinic, Connecticut Children's Hospital, Mount Sinai Health System and Texas Children's Hospital have reached similar settlements — at least six major hospitals in total. All deny wrongdoing and say pediatric mental health programs and care for patients 18 and older are unaffected. Last year, federal authorities opened investigations into more than 20 hospitals, including the Children's Hospital of Philadelphia (CHOP) and Nemours Children's Health in Delaware, seeking confidential medical records of transgender youth to review for potential healthcare fraud; in the UPMC case, a federal judge denied the DOJ's records demand in March, and the department abandoned its appeal in August.\u003C\u002Fp>\r\n\u003Cp>\"It's a really dangerous precedent when the federal government is allowed to politicize any one group of people's care and end it,\" said Eliel Cruz, a cofounder of the Gender Liberation Movement. Twenty-one states and the District of Columbia sued on September 2 to block the rule. CHOP, which successfully fought in court to protect patient records, did not reply to questions about whether it is negotiating with the DOJ; Nemours declined to comment. Transgender rights advocates say the mounting legal and political pressure has intensified an atmosphere of fear, while hospital lawyers and LGBTQ legal groups say they will challenge the rule in court.\u003C\u002Fp>\r\n\u003Cp>Analysts describe the rule as one front in a multi-pronged Trump administration campaign to curtail gender-affirming care for minors — from a January 2025 executive order and a December 2025 rule proposal to parallel congressional bills. More than half of states already restrict such care by state law; the federal move now reaches into the roughly 23 states where it remains legal. Because Medicaid covers about half of American children, the funding lever's impact goes far beyond paper: states are already splitting between those backfilling with state dollars (Oregon, where state law requires continued coverage) and those complying outright (Colorado, Michigan). In states where the care remains legal, low-income trans youth are the first to be squeezed out of the federal-state standoff.\u003C\u002Fp>\r\n\u003Cp style=\"text-align:right;\">North American
