A Hong Kong court has delivered a judgment in a civil tort action arising from fraudulent gender misrepresentation on a dating application. An unemployed man, Tsang Tsz-ho, concealed his biological sex on an exclusively lesbian platform to induce a lesbian plaintiff into engaging in sexual intercourse. While the defendant was previously acquitted of criminal charges of rape and indecent assault in a jury trial, the plaintiff subsequently pursued personal injury litigation in the civil courts seeking damages for post-traumatic stress disorder (PTSD), culminating in an award of HK$367,000 in compensation plus approximately HK$20,000 in legal costs.

In the assessment of damages, the court master found the plaintiff's testimony entirely credible and reliable. The court awarded HK$250,000 for pain, suffering, and loss of amenities (PSLA), accounting for the profound emotional distress and disruption to her daily life. Furthermore, holding that the defendant's conduct was deeply insulting and severely damaged the plaintiff's self-esteem as a gay woman, the master awarded an additional HK$80,000 in aggravated damages. Although the defendant filed an initial notice of intention to defend in January 2024, he failed to serve a defense statement and never attended subsequent court hearings, resulting in judgment entered in default regarding liability and quantum.

Psychological assessments detailed the severe long-term impact of the tortious conduct on the plaintiff's mental health. Clinical records show she began consultations with a psychologist in May 2022, experiencing an acute deterioration by December 2023 characterized by recurrent nightmares of rape and assault, avoidance of unfamiliar men, and extreme hypervigilance in public spaces, leading to a formal PTSD diagnosis. Following prolonged therapeutic intervention, her condition stabilized by August 2025, though clinical evaluations noted persistent public hypervigilance remaining as an ongoing consequence.

Legal analysts observe that the decision underscores the critical function of civil litigation in redressing violations of sexual autonomy where criminal avenues prove insufficient. While the criminal standard of proof beyond reasonable doubt often struggles to penalize sexual intimacy procured through deception of identity, common law tort principles operating on the balance of probabilities provide a viable framework to sanction fraudulent deceit. By recognizing psychiatric harm and awarding aggravated damages, the court established an important precedent holding online predators accountable for violating bodily integrity and personal dignity.
